Has your UK trade mark opposition been filed on time?

A two month opposition term, which can be extended by a further month upon request, is set for opposing UK trade marks. If an opposition is to be filed it is crucial that this time period is adhered to. How this time period is calculated has been changed (again!).

Calculation of the opposition period for UK trade marks changed on 1st April 2013. Previously, the deadline to oppose a UK trade mark application expired two months beginning on the date of publication. For example, a UK trade mark application which was published on 4th January 2013 was open to opposition until 3rd March 2013. As of 1st April 2013, however, the deadline to oppose a UK trade mark application will expire two months from the date of publication. As an example, a UK trade mark application which was published on 4th April 2013 will now be open to opposition until 4th June 2013. This in fact returns the law to the previous position, and will hopefully make matters clearer for potential opponents.
